Any hosting account that is used for illegal, abusive or unethical activity may be immediately suspended by Fused Network without warning to you. Any misuse, overusage or abuse of the service will result in immediate suspension of an account. Illegal, abusive or unethical activities include, but are not limited to inclusion of or linking to violations of privacy, hacking, botnet related scripts and programs, non approved server scripts, eggdrops, proxies, computer virus, gambling, or promotion of gambling, and any harassing or harmful materials or uses, as determined by Fused.
You agree to indemnify and hold Fused Network harmless from any claim resulting from your publications or use of illegal, abusive or unethical materials. Although we will make reasonable efforts to alert you to such activities and allow you an opportunity to cure them within a 6-hour period after discovery, we are not required to give notice before suspending/terminating your use of our services if, in our discretion, your use is or results in illegal, abusive or unethical activities.
Fused Network reserves the right to suspend/cancel/terminate any account at any time for any reason. There will be no tolerance of any abuse of any of our support methods, which could result in immediate suspension.
Please understand that all information submitted on the hosting account shall be considered publicly accessible. A backup of any content you host with fused should be protected/backed up by you & we accept no responsibility for loss of data or financial losses that are incurred as a result of acts of God, breaches, hardware failure or any other reason. Fused Network is not liable for protection or privacy of electronic mail or other information transferred through the Internet or any other network provider that you may use.
You are expressly prohibited from sending unsolicited bulk mail messages ('junk mail' or 'spam'). This includes, but is not limited to, bulk-mailing of commercial advertising, information announcements, and political tracts. In accordance with the CAN-SPAM ACT of 2003 S. 877, such material may only be sent to those who have specifically requested it. Malicious or threatening email is also prohibited. Fused Network reserves the right to immediately suspend or terminate your use of our service if we discover such activity. Furthermore, you agree to indemnify and hold Fused Network harmless from any claim resulting from your use or distribution of electronic mail services through the service provided through this Agreement. Anyone using Fused Network's services for spamming will be immediately subject to a $250 cleanup/network abuse fee.
All payments are due on time, without exception. Chargebacks & bounced checks are subject to a $50 fee. Accounts with any past due invoices are at risk of suspension and late fees. Any account suspended for more than a 30 day period will be terminated, by Fused Network, without backup.
Fused Network retains the right not to assist clients with third party applications. This includes any script uploaded by the client, installed using cPanel, it's scripts library or any installer within. Any assistance, support, or troubleshooting provided by Fused Network for ANY third party script or application will be potentially subject to an hourly service fee.
Shared hosting accounts are intended to be utilized by the original account holder only and anyone attempting to resell their allocated space or bandwidth to other users will be suspended indefinitely.
In the event you cancel your service, a pro-rated refund is available for any remaining credit on file.
Fused offers only pro-rated refunds on shared, semi-dedicated & dedicated hosting services. Domain names & other services are non-refundable.
Fused Network Corp.'s (“Fused”) policy is to respect your privacy regarding any information we may collect while operating our websites & services.
Like most website operators, Fused collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Fused’s purpose in collecting non-personally identifying information is to better understand how Fused’s visitors use its website. From time to time, Fused may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.
Fused also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users. Fused only discloses logged in user and commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below.
Certain visitors to Fused’s websites choose to interact with Fused in ways that require Fused to gather personally-identifying information. The amount and type of information that Fused gathers depends on the nature of the interaction. For example, we ask visitors who sign up for an account at fused.com to provide a username, email address, and password. Those who engage in transactions with Fused – by purchasing web hosting, for example – are asked to provide additional information, including as necessary the personal and financial information required to process those transactions. In each case, Fused collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with Fused. Fused does not disclose personally-identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.
Fused may collect statistics about the behavior of visitors to it's client websites. For instance, Fused may monitor access to various websites we host to prevent abuse. Fused may display this information publicly or provide it to others. However, Fused does not disclose personally-identifying information other than as described below.
Fused discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Fused’s behalf or to provide services available at Fused’s websites, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using Fused’s websites, you consent to the transfer of such information to them. Fused will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, Fused discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when Fused believes in good faith that disclosure is reasonably necessary to protect the property or rights of Fused, third parties or the public at large. If you are a registered user of a Fused website and have supplied your email address, Fused may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Fused and our products. We expect to keep this type of email to a minimum. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Fused takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.
If Fused, or substantially all of its assets, were acquired, or in the unlikely event that Fused goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Fused may continue to use your personal information as set forth in this policy.
